Antitrust & Merger Control

Antitrust law is not confined to large corporations. Small and medium-sized businesses may also be affected by competition-law requirements, for example in distribution agreements, collaborations, information exchange, market conduct or corporate transactions. We provide preventive advice and represent companies in administrative and court proceedings.

Our advice

We review agreements and business practices under Austrian and EU competition law. This includes horizontal and vertical cooperation, distribution and purchasing arrangements, exclusivity, pricing, information exchange and the conduct of companies with significant market power. Legal risks are translated into workable structuring and conduct options.

For concentrations, we assess at an early stage whether a filing may be required in Austria, at EU level or in other relevant jurisdictions. We coordinate the necessary information, prepare notifications and advise throughout the clearance process. Transaction documents and closing planning are aligned with merger-control requirements.

In investigations and court proceedings, we represent clients before the Austrian Federal Competition Authority, the European Commission and the cartel courts. We assist with requests for information and dawn raids, internal fact-finding, commitments, damages matters and the development or review of compliance structures.

Our approach
