In acquisitions and disposals, we review the legal position of the property, draft purchase and option agreements and coordinate escrow arrangements, financing, the self-assessment or filing of transaction-related taxes, release of encumbrances and registration in the Land Register.
Our long-standing work with property developers gives us particular experience in structuring and implementing property-development projects. Our advice ranges from development and project financing through condominium ownership, property-development agreements and ongoing project support to land-transfer and spatial-planning matters. We take account of the applicable statutory safeguards and information requirements and the interfaces between acquisition, construction and use agreements.
In construction matters, we advise principals, developers, planners and contractors on drafting, variations, additional costs, delay, defects and acceptance. The objective is to allocate scope, remuneration, deadlines, documentation and liability clearly before uncertainty develops into an expensive dispute. We represent clients in construction litigation concerning the enforcement and defence of resulting claims.
For tenancies and leases, we draft and review agreements by reference to the applicable statutory regime. We advise on indexation, service charges, maintenance, amendments and termination and represent clients in out-of-court and court proceedings.
Our approach
We do not consider the property in isolation, but as a legal and commercial project as a whole. The contractual framework, payment schedule, financing and Land Register completion are coordinated so that risks are identified early and the process remains manageable.
